1OUR APPROACH TO RIGHTS
DarkRush Music respects copyright, performers’ rights, trade marks and other intellectual-property rights. Music and creative assets can involve multiple rights holders, and we take credible infringement reports seriously.
This policy provides a practical route for reporting material on the DarkRush Music website that you believe infringes rights you own or are authorised to enforce.
2BEFORE SENDING A NOTICE
Please consider whether the use may be authorised by a licence, permission, ownership arrangement or an exception under applicable law. Copyright infringement generally concerns unauthorised use of the whole or a substantial part of a protected work where no applicable exception applies.
3WHAT TO INCLUDE IN A TAKEDOWN NOTICE
Send a notice to legal@darkrushmusic.com containing:
- your full name and, if applicable, organisation;
- an email address and telephone number where we can contact you;
- identification of the copyrighted work or other right you say is infringed;
- the exact URL(s) or sufficiently precise location of the material complained about;
- an explanation of why you believe the use is unauthorised;
- information showing that you own the relevant right or are authorised to act for the owner;
- a statement that the information in your notice is accurate to the best of your knowledge; and
- any supporting documents that will help us assess the claim.
Please do not knowingly make false or misleading claims.
4WHAT WE MAY DO
After receiving a sufficiently detailed notice, we may:
- acknowledge the report;
- request further information;
- temporarily restrict access to disputed material while we investigate;
- contact the person, artist, supplier or rights holder who provided the material;
- remove, replace or restore material as appropriate; and
- preserve relevant records where reasonably necessary for a dispute or legal obligation.
Submitting a notice does not guarantee removal. We will consider the information available, applicable rights, permissions and legal exceptions.
5RESPONSES AND COUNTER-INFORMATION
If material you supplied is removed or restricted following a complaint, you may contact legal@darkrushmusic.com with evidence that you own or are authorised to use the material, or explaining why the use is otherwise lawful.
Where appropriate, we may share the substance of a complaint with the affected contributor so the matter can be understood and resolved. Personal information is handled in accordance with our Privacy Policy.
6REPEAT OR SERIOUS INFRINGEMENT
We may restrict contributions, access or relationships where there is evidence of repeated, deliberate or serious infringement, subject to the circumstances and any contractual rights.
7NO DETERMINATION OF OWNERSHIP
DarkRush Music cannot adjudicate complex ownership disputes through a website takedown process. Where competing parties provide credible evidence, we may keep material unavailable while they resolve the dispute directly, through their representatives, a collecting society, mediation or the courts.
8DARKRUSH MUSIC MATERIAL USED ELSEWHERE
If you wish to license DarkRush Music-controlled recordings, artwork or other material, contact sync@darkrushmusic.com or legal@darkrushmusic.com. Do not assume that material displayed on this Site is cleared for reuse.
