PLEASE READ THESE TERMS BEFORE SENDING MUSIC TO DARKRUSH MUSIC.
1PURPOSE
These Demo Submission Terms apply whenever you submit music, recordings, compositions, links, artwork, biographical information or other creative material (“Submission”) to DarkRush Music for A&R consideration.
2AUTHORITY TO SUBMIT
By submitting material, you confirm that:
- you are at least 18 years old, or you have the involvement and permission of a parent, guardian or authorised representative where required;
- you own or control the Submission, or have permission from everyone whose rights are needed to send it to us for evaluation;
- your Submission and our internal review of it do not knowingly infringe copyright, performers’ rights, privacy, confidentiality, contractual or other rights;
- the information you provide is accurate to the best of your knowledge; and
- you are not breaching an exclusive agreement or other obligation by making the Submission.
If a Submission contains third-party beats, samples, features, co-writers, producers or other material, you should have appropriate authority to submit it.
3YOU KEEP YOUR RIGHTS
Submitting a demo does not transfer ownership of your recording, composition, name, image or other intellectual property to DarkRush Music.
You give DarkRush Music a limited, non-exclusive permission to access, stream, copy internally where technically necessary, and share the Submission with authorised team members and professional advisers solely for evaluation, administration and related discussions.
4NO OBLIGATION TO LISTEN, RESPOND OR ENTER AN AGREEMENT
We receive material from many sources. DarkRush Music is not obliged to listen to, review, retain, return or respond to any Submission and is not obliged to offer a recording, distribution, publishing, management, services or other agreement.
No contract or commercial relationship exists unless and until the relevant parties sign a separate written agreement.
5NO CONFIDENTIALITY OR FIDUCIARY RELATIONSHIP
Unless DarkRush Music has expressly agreed otherwise in writing before submission, unsolicited Submissions are not accepted on a confidential basis.
Your Submission does not create a fiduciary, agency, partnership, employment, management, advisory or other special relationship. Do not submit trade secrets or information that you require us to keep confidential.
This does not permit DarkRush Music to infringe your intellectual-property rights.
6SIMILAR MATERIAL
Music and creative ideas can share common themes, titles, sounds, concepts, chord progressions, production techniques and subject matter. DarkRush Music, its roster, writers, producers or partners may already be developing, or may later independently develop or receive, material that resembles aspects of your Submission.
The fact that later material has similarities does not by itself establish copying or create an obligation to you. Nothing in these Terms waives any rights you may have in protectable original material.
7HOW TO SUBMIT
Use the official DarkRush Music demo form where available. We prefer private streaming links that remain available for a reasonable review period. Do not send executable files, unsolicited large attachments or passwords unless specifically requested.
Please provide accurate contact details and enough context for us to understand the project.
8PERSONAL INFORMATION
We use information connected with your Submission for A&R evaluation, contact, administration, security and record-keeping as described in our Privacy Policy.
A&R notes and submission status may be accessible to authorised DarkRush Music personnel. We periodically review demo information and do not intend to keep unsuccessful submissions indefinitely where there is no continuing business need.
9UNDER-18 SUBMITTERS
If you are under 18, please involve a parent, guardian, manager or other appropriate adult before submitting. We may ask for adult involvement before discussing contracts, rights or commercial arrangements.
10THIRD-PARTY LINKS
If you submit a private link hosted by another service, that service’s terms and privacy practices also apply. Make sure the link permissions allow our authorised team to review the material.
11WITHDRAWAL AND UPDATES
You may ask us to update or delete personal information associated with a Submission, subject to any lawful reason we need to retain limited records. Contact demos@darkrushmusic.com or privacy@darkrushmusic.com.
Deleting personal information does not necessarily require deletion of records we must retain for legal claims, security, suppression or contractual reasons.
12CHANGES TO THESE TERMS
We may update these Terms as our submission process changes. The version displayed when you submit will apply to that Submission unless applicable law requires otherwise.
13GOVERNING LAW
These Terms are governed by the laws of England and Wales, subject to any mandatory rights that apply to you.
