1ABOUT THESE TERMS
These Terms of Use govern your access to and use of the DarkRush Music website, including our catalogue, roster profiles, preview player, journal, events, press materials, smart links, forms and other online services (the “Site”).
The Site is operated by DarkRush Music Ltd (“DarkRush Music”, “we”, “us” or “our”), whose registered office is LSC House, Murray Road, Orpington, England, BR5 3QY.
By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
2INFORMATION ONLY — NO PROFESSIONAL OR COMMERCIAL OFFER
Content on the Site is provided for general information and promotion of DarkRush Music, its catalogue, roster, projects and activities. Nothing on the Site constitutes legal, financial, investment or other professional advice. Displaying a person, release, opportunity, event or service does not guarantee availability, representation, a recording agreement, a licence or any other commercial relationship.
3INTELLECTUAL PROPERTY
Unless stated otherwise, the Site and its content — including recordings, compositions, audio previews, artwork, photographs, video, graphics, logos, trade marks, text, layouts, software and databases — are owned by, licensed to, or used with permission by DarkRush Music and/or the relevant rights holders.
You may view the Site for personal, non-commercial use. You must not copy, reproduce, rip, scrape, download, redistribute, broadcast, communicate to the public, modify, create derivative works from, sell, license or commercially exploit Site content unless applicable law permits it or you have prior written permission from the relevant rights holder.
No rights in any recording, composition, trade mark or other intellectual property are transferred to you by your use of the Site.
4AUDIO PREVIEWS AND STREAMING LINKS
Audio made available through the preview player is provided for personal listening and promotional purposes only. You must not circumvent preview limits, extract audio, create permanent copies, use previews to train machine-learning systems, or redistribute them.
Links to Spotify, Apple Music, YouTube, SoundCloud, Bandcamp and other third-party platforms are provided for convenience. Those services have their own terms and privacy practices, and DarkRush Music is not responsible for their availability or content.
5ACCEPTABLE USE
You must not:
- use the Site unlawfully, fraudulently or to infringe another person’s rights;
- attempt to gain unauthorised access to the Site, admin area, servers, databases or accounts;
- introduce malware, malicious code, automated attacks or excessive traffic;
- scrape, harvest or systematically extract personal data, catalogue information or Site content without permission;
- impersonate DarkRush Music, a member of our roster, team or another person;
- submit content that is defamatory, threatening, discriminatory, obscene, deceptive or unlawful;
- use contact, demo or newsletter facilities for spam or unsolicited bulk communications; or
- interfere with the security, integrity or normal operation of the Site.
We may restrict or block access where reasonably necessary to protect the Site, our users or our rights.
6SUBMISSIONS AND CONTACT
Information sent through our contact forms is handled in accordance with our Privacy Policy. Demo submissions are also governed by the separate Demo Submission Terms. Sending us material does not create a confidential, fiduciary, agency, management, publishing, recording or other relationship unless we agree otherwise in a signed written agreement.
7THIRD-PARTY CONTENT AND LINKS
The Site may contain embedded media, links, ticketing services, streaming platforms, social networks and other third-party services. We do not control those services and are not responsible for their terms, privacy practices, security, content, availability or transactions. You use them at your own discretion.
8ACCURACY AND AVAILABILITY
We aim to keep the Site accurate and available, but release dates, event details, credits, links, roster information and other content may change. We do not guarantee that the Site will always be uninterrupted, error-free, secure or current. We may change, suspend or withdraw any part of the Site without notice where reasonably necessary.
9LIABILITY
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
To the fullest extent permitted by law, DarkRush Music is not liable for indirect or consequential loss arising from use of, inability to use, or reliance on the Site, or from third-party services linked from it. If you use the Site for business purposes, we are not responsible for loss of profit, revenue, business, anticipated savings, goodwill or business opportunity arising from your use of the Site.
Your statutory rights as a consumer are not affected.
10PRIVACY AND COOKIES
Our Privacy Policy explains how we handle personal information. Our Cookie Policy explains our use of cookies, local storage and similar technologies. Non-essential analytics or tracking technologies are not activated until the required consent has been obtained.
11CHANGES TO THESE TERMS
We may update these Terms to reflect changes to the Site, our services, law or business practices. The current version will be published here with an updated effective date. Material changes may also be highlighted on the Site where appropriate.
12GOVERNING LAW
These Terms are governed by the laws of England and Wales. If you are a consumer, you may also benefit from mandatory protections and rights to bring proceedings in the part of the United Kingdom in which you live. Business users agree that the courts of England and Wales have exclusive jurisdiction, subject to any mandatory law that applies.
